The California Division of Truthful Employment and Housing has filed a lawsuit towards Tesla Inc. alleging systematic racial discrimination and harassment.
Tesla said on Wednesday the DFEH intended to file a lawsuit.
The lawsuit seems to be centered on alleged misconduct at its manufacturing unit in Fremont, California, between 2015 and 2019.
The lawsuit, Division of Truthful Employment and Housing Vs. Tesla, Inc., was filed within the Superior Courtroom of the State of California within the County of Alameda.
The lawsuit notes that the Fremont manufacturing unit accommodates greater than 15,000 Tesla staff alone, and that “Black and/or African American staff are segregated to the bottom ranges,” making up 0% of executives and roughly 3% of pros, whereas some “20% of manufacturing unit operatives, similar to engine and different machine assemblers, are Black and/or African American staff.
The swimsuit additionally states: “Segregation on the Fremont manufacturing unit, together with the absence of Black and/or African People in management roles, has left many complaints of rampant racism unchecked for years. As early as 2012, Black and/or African American Tesla staff have complained that Tesla manufacturing leads, supervisors, and managers continuously use the n-word and different racial slurs to check with Black staff.”
Based on the swimsuit, these staff have complained that swastikas, “KKK,” the n-word, and different racist writing are etched onto partitions of restrooms, restroom stalls, lunch tables, and manufacturing unit equipment.
“They’ve complained that Black and/or African American staff are assigned to extra bodily demanding posts and the lowest-level contract roles, paid much less, and extra usually terminated from employment than different staff,” criticism continues.
The swimsuit alleges that Tesla has restricted investigations of such incidents, and that staff have been discouraged from complaining.
DFEH’s enforcement motion “seeks to treatment, stop, and deter illegal harassment, discrimination, and retaliation” on behalf of all Black and/or African American staff.
The division can be looking for compensatory and punitive damages, financial damages, injunctive aid and declaratory aid. Among the many financial damages sought are pay changes, backpay, misplaced wages and advantages.
